Exiting President’s Letter

Dear CCEA,

I am extremely happy to let you know that Mayra Turchiano will be stepping up as CCEA President. Mayra is enthusiastic, motivated, intelligent, and super organized, and you are in very good hands. Mayra will be joined by some new board members and officers who are stoked to be with CCEA.

I also greatly appreciate our board members’ hard work during contract negotiations, a global pandemic, and all the other issues that come before CCEA during the last 2 years.

Working for CCEA is incredibly rewarding, sometimes difficult, but always fun. It’s bittersweet to leave, but rest assured that your new board is motivated and excited.

President’s Letter

Dear CCEA,

It is my great pleasure and honor to accept the appointment of President to the Carlsbad City Employee Association Board of Directors. The road ahead is at times difficult; however, I feel ready for the challenge as I have had the opportunity to learn from two great leaders; Hallie Thompson and Tye Gillespie.

Furthermore, working with CCEA for the last six years has also proven to be extremely rewarding and satisfactory fueling my commitment with all of you to continue to do my very best to advocate for our members.

I also want to thank the exiting board members for their time, dedication and extraordinary labor of love on behalf of all CCEA members.

CCEA Parks Representative Vacancy

Fair Labor Standards Act Change

In 2016, the Ninth Circuit U.S. Court of Appeals decision in the case of Flores v. City of San Gabriel (824 F.3d 890)

Required that employers treat all cash an employee receives back as taxable income from their employer’s contribution to the employee’s healthcare plan benefit be included in the regular rate of pay for purposes of calculating the employee’s FLSA overtime pay

Statute of limitations is up to 3 years

This clarification to the Fair Labor Standards Act (FLSA) requires the city to adjust the way it calculates overtime to remain in accordance with the law.

Therefore, the City of Carlsbad and the Carlsbad City Employees’ Association have met and conferred in good faith and reached an agreement regarding the calculation of FLSA overtime and FLSA comp time premium for a few of our current and former CCEA members. The impacted members will be contacted by Human Resources.

The total “settlement amount” includes the amount the city underpaid, per the settlement methodology agreed upon by the city and CCEA, plus “liquidated damages,” which doubles the amount the city underpaid.

A settlement payment will be paid out on condition that you sign and return the settlement and release agreement. If you agree to settle, settlement payments for current employees will be processed via the city’s payroll system on a specified date that has not yet being shared with CCEA.

Board meetings are open to all CCEA members with the exception of the closed session portion of the meetings. The board meets every first Tuesday of the month via Zoom 12 p.m. – 1 p.m.
